Whether or not someone initially qualifies for legal aid depends largely on their income-level. However, in order to obtain and maintain a legal aid certificate you must also satisfy the conditions laid out in the LAO’s merit assessment. There are limited circumstances where the court recognizes a need to tend to a matter immediately and will thus grant an urgent motion.

Situations that may be considered urgent by the court include but are not limited to instances where you can prove that:

• There is an immediate risk that your partner will take your child(ren) away or seriously harm you or your child(ren).

• Your partner is not complying with a parenting agreement and withholding your child(ren).

• You will face undue hardship by prolonging the matter because you do not have enough money to pay your bills and your debtors have threatened to take legal action against you.
